The use of studentexperience.filmbankconnect.com is subject to the terms below.

Users will:

1. maintain the confidentiality of their Platform login details and not disclose them to third parties;

2. only view the Content (or attempt to do so) whilst they are located in the Permitted Playback Locations;

3. not resell, rent, lease or otherwise permit access to the Services for a third party;

4. not obtain unauthorised access to any Service or any of the underlying cloud infrastructure (nor seek to do so);

5. not circumvent any subscription restrictions that are applied or enforced by the Platform nor seek to do so;

6. not circumvent any digital rights management applied to Content nor seek to do so;

7. immediately notify Filmbankmedia if they become aware of any disclosure or unauthorised use of their Platform account or login details or any other security breaches in relation to the Services; and

8. not use the Services in any way that violates, plagiarises or infringes upon the rights of any others, including copyright, trade mark, the right of privacy or the right of publicity, or uses the Services in a way that would be abusive, profane, obscene, indecent, threatening, defaming, slanderous, libellous, offensive, or illegal.

Filmbankconnect End User Agreement

Filmbankconnect is a service operated by Filmbank Distributors Limited (“We”/”we”/”us”). We are registered in England and Wales under company number 01021212 and have our registered office at Warner House, 98 Theobald’s Road, London WC1X 8WB. Filmbankmedia is our trading name.

By using Filmbankconnect (the “Service”), you confirm that you accept the terms of this end user agreement and that you agree to comply with them. We reserve the right to suspend or terminate your access to the Service if you breach or attempt to breach any of the terms of this End User Agreement.

We amend these terms from time to time. Every time you wish to use this Service please check the terms to ensure you understand the terms that apply at that time. You are also responsible for ensuring that all persons who access our Service through your devices are aware of these terms of use and the other terms and conditions, and that they comply with them.

If you choose, or are provided with a user identification code, password or any other piece of identification as part of our security procedures or those of the organisation that provides your internet connectivity, you must treat such information as confidential. You must not disclose to any third party.

We are the owner or the licensee of all intellectual property rights in our Service, and in the content published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved*.

You must not use any part of the content on our Service for commercial purposes without obtaining a licence to do so from us.

You shall not conduct, facilitate, authorise or permit any text or data mining or web scraping in relation to our Service or any services provided via, or in relation to, our Service. This includes using (or permitting, authorising or attempting the use of):

• Any “robot”, “bot”, “spider”, “scraper” or other automated device, program, tool, algorithm, code, process or methodology to access, obtain, copy, monitor or republish any portion of the Service or any data, content, information or services accessed via the same.
• Any automated analytical technique aimed at analysing text and data in digital form to generate information which includes but is not limited to patterns, trends and correlations.

Whether you are a consumer or a business user we do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.

If you are a business user we exclude all implied conditions, warranties, representations or other terms that may apply to our Service or any content on it.

We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

• use of, or inability to use, our Service; or
• use of or reliance on any content displayed on our Service.

In particular, we will not be liable for:

• loss of profits, sales, business, or revenue;
• business interruption;
• loss of anticipated savings;
• loss of business opportunity, goodwill or reputation; or
• any indirect or consequential loss or damage.

If you are a consumer, please note that we only provide our Service for domestic and private use. You agree not to use our Service for any commercial or business purposes, without limiting the foregoing you will not resell, rent, lease or otherwise permit access to the Services for a third party, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

We do not guarantee that the Service will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programmes and platform to access our Service. You should use your own virus protection software.

You must not misuse our Service by knowingly introducing any virus or other form of malicious or actual or potentially harmful material or technology or attempt to attack the Service in any way with malicious intent. You must not attempt to gain unauthorised access to our Service, the server on which the Service is stored or any server, computer or database connected to our Service. By breaching any of these provisions you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorised by disclosing your identity to them. In the event of such a breach, your right to use our Service will cease immediately.

You may use the content made available by us on the Service whilst you are located at a location approved by us (“Permitted Playback Locations”). You must not attempt to obtain unauthorised access to the Service or any of the underlying cloud infrastructure. Without limiting the generality of the foregoing, any attempt to access the Service from anywhere other than a Permitted Playback Location will be blocked by us and your right to use the Service will be suspended or terminated at our discretion.

You must not :

• circumvent any subscription restrictions that are applied or enforced by the Service nor seek to do so;
• not circumvent any digital rights management applied to Content nor seek to do so;
• use the Service in any way that violates, plagiarises or infringes upon the rights of any others, including copyright, trade mark, the right of privacy or the right of publicity, or uses the Service in a way that would be abusive, profane, obscene, indecent, threatening, defaming, slanderous, libellous, offensive, or illegal.

If you become aware of any security breaches in relation to the Service you agree to immediately notify Filmbankmedia.

Our trademarks (Filmbankmedia and Filmbankconnect) are UK and EU registered trade marks. You are not permitted to use them without our approval.

Disputes in relation to these terms of use, their subject matter and their formation are governed by the laws of England and Wales. You are we both agree that the courts of England and Wales will have exclusive jurisdiction.

*this does not apply where the Service is provided on a white label basis.
